Mayor picks new resident to fill council vacancy

The wait is over. Biddeford Mayor Marty Grohman is expected today to formally announce his nomination to fill one of the two vacant seats on the city council.

According to multiple sources, Grohman has selected Neva Gross to take over the Ward Five council seat that was vacated by the resignation of former Councilor Julian Schlaver last month.

Schlaver, who ran unopposed for the seat in the Nov. 2023 municipal election, announced in April that he would be stepping down for “personal reasons.’

On Tuesday, May 7, the council voted unanimously to officially accept Schlaver’s resignation.

Ward Five includes the city’s downtown area, including the sprawling complex of renovated mill buildings and densely packed neighborhoods near the city’s core.

Gross, 49, said she is excited to serve on the council. She has lived in Biddeford for roughly 18 months and resides at the Lincoln Lofts. She graduated last year from the University of New England’s School of Pharmacy and holds a doctorate’s degree in pharmacology.

Grohman said he was pleased that several people expressed interest in serving on the council.

Others who expressed interest in the Ward Five post include Syed Zafar, a member of the Zoning Board of Appeals, Assessment Review Board and the city’s Diversity, Equity, and Inclusion (DEI) Committee; and Dominic Deschambault, a former School Committee member who now serves on the board of directors for the Biddeford Housing Authority.

According to the city’s charter, the city council must vote to confirm the mayor’s nominee. The council is expected to vote on that nomination this evening during a special council meeting.

The appointment of Gross to the city council will still leave one vacancy on the council, however.

On April 9, former Ward 4 councilor Bobby Mills resigned his seat roughly 48 hours after he was arrested and charged with operating a motor vehicle under the influence of alcohol.

The timing of Mills resignation triggered the need for a special election.

According to the city’s charter, if a member of the council resigns within 180 days of the last election, a special election must be held to fill that vacancy. That election will take place on June 11, the date when voters will also decide whether to approve the school budget.

Schlaver’s resignation, however, was not formally accepted until this week, giving the mayor the power to appoint a replacement councilor.

Although Mills told Saco Bay News in April that he was interested in running to capture the seat that he resigned, only one resident actually turned in nomination papers with the required number of signatures to be on the ballot.

Dylan Doughty, who was appointed earlier this year as an alternate member of the Biddeford Planning Board, said he is “looking forward” to serving on the city council.

Doughty, 32, is a native of Arkansas who relocated to Maine three years ago for his job. He said he “loves the city of Biddeford” and is “excited about the opportunity to represent his neighbors.”

Doughty is employed as a senior buyer at General Dynamics in Saco. He has an MBA degree from Western Colorado University.

During a brief interview on Wednesday evening, Gross said she has “fallen in love” with the city.

“I came here during a blizzard to interview at the university, and I just felt instantly connected,” she said.

Over the past few months, Gross says she has been working to connect with her new hometown, including volunteer work with the Seeds of Hope Neighborhood Resource Center.

“I don’t have any political bias,” she said. “I like to be transparent and fair-minded. I know I’m stepping into a process that is already moving forward, but I do have the energy to jump in and see how I can help.”

Grohman said that he and Council President Liam LaFountain have personally interviewed each person who expressed interest in the Ward Five seat over the last two weeks.

“It’s gratifying to see the level of interest in community service,” Grohman said. “I look forward to working with [Gross] over the remainder of the term,” Mayor Grohman said. “Her unique experiences, like her work in the field of unhoused services, managing a popular restaurant here in Biddeford, and her service in the US Army, will bring a new and valuable perspective to our city council.”

Running for elected office is not easy; not by a long shot.

But I am so proud of my wife; proud of her courage, her determination and her fiercely independent spirit.

It’s the two-week stretch, and no matter the outcome, I have enjoyed watching Laura grow and face her challenges head-on. She’ll make one hell of a city councilor.

Boys Don’t Cry

Maybe it was the heat.

Maybe it was that more than 150 people had packed themselves into the tiny and cramped Biddeford City Council Chambers.

More than likely, it was because tensions remain high between the city council and the Teamsters union that represents the city’s police, fire and public works department in ongoing contract negotiations.

But for whatever reason, only a few minutes into the July 7 council meeting, chaos erupted and the meeting was quickly adjourned before it ever really started.

It was a spectacle to watch; embarrassing on many levels and completely avoidable.

Although it was a powder keg in search of a match, the first moments of the meeting seemed routine. There was the Pledge of Allegiance and everyone stood, removed their hats and paid homage to our nation’s flag.

And then, Mayor Alan Casavant asked for a moment of silence to recognize the passing of two distinguished citizens.

Again, everyone in the room was completely respectful, bowing their heads in a moment of silence. But then, gazing at the crowd that literally surrounded the council, Casavant simply asked some attendees to stand in the hallway in order to comply with building safety codes.

The crowd of mostly Teamsters and their supporters refused to budge. “We’re not going anywhere,” they shouted, quickly followed by thunderous applause.

One of the councilors (from the videotape of the meeting it remains unclear who it was) responded, “Do you want us to shut it down?”

In unison, the angry Teamsters began chanting: “Shut it down! Shut it down!”

One councilor quickly made a motion to adjourn the meeting, it was just as quickly seconded. And a majority of councilors voted to adjourn the meeting before it ever really started.

The Teamsters were visibly upset. They stood in place, screaming at the councilors and chanting: “Shame on you! Shame on you!”

The people’s business went unfinished. No member of the public was able to address the council. It was a poor reflection of a great city.

The Blame Game

So who’s to blame for the complete breakdown in civility, decorum and common courtesy?

Well, there’s plenty of blame to go around for this circus show, so let’s start at the top.

With nearly two terms under his belt as the city’s mayor, four terms as a state legislator and prior experience as a city councilor (not to mention teaching psychology at Biddeford High School), Mayor Alan Casavant should have seen this coming well in advance.

Casavant should have changed the venue for the meeting to accommodate what everyone knew was going to be a capacity crowd.

Casavant failed to lead because of his embedded belief in the decency of his fellow citizens. He thought he could simply ask for order, and his request would be honored. That’s not how the real world works. It may have worked in his classroom, but the mayor simply cannot be so naïve as to think the meeting was not going to be raucous and overcrowded.

Casavant was elected to be a leader, not to be a nice guy.

In the final moments of the meeting, Council President John McCurry leaned over to Casavant and said, “You need to get a handle on this situation.”

McCurry was right.

But the blame does not rest solely with Casavant.

Assets, not liabilities

Although a majority of the council was angry, there was no need to threaten to “shut down” the meeting. The council could have sat idly until the crowd complied, ordering public access television to be paused and waiting for things to settle down.

Instead, at least one of the councilors issued an ultimatum: “Do you want us to shut it down?”

That did not fly with the Teamsters.

Whether they like it or not, the council has a responsibility to hear its citizens’ concerns and grievances. It also has a responsibility to hear those same concerns from city employees, many of whom are also residents.

I have been covering Biddeford politics for the better part of two decades, and there seems to be a constant, pervasive theme that transcends each administration: City employees are liabilities, not assets. In reality, it is the other way around.

The council has its position in the negotiations, but it is unrealistic to expect that those on the other side of the table are going to simply accept what is offered, especially when the offer (according to sources from within the union) is such a low-ball offer.

Furthermore, the council cannot lay all the blame at the mayor’s feet. They should have made a motion to move the meeting to a different venue at a different time in order to accommodate the crowd.

Instead, they stubbornly insist that all future meetings will be held in the cramped city council chamber.

Men To Boys

Biddeford’s police, fire and public works employees are some of the hardest working, most decent people you will ever come across.

It appears that the union has a legitimate beef with the negotiations. They are being asked to sacrifice a lot. Perhaps, this is the city’s negotiating tool: a ridiculous low-ball offer that can be incrementally worked up.

But we are not talking about buying a Ford F-150 or a Toyota Prius.  We are talking about men and women who will literally put their lives on the line for you and me.

I do not know how much police officers or firefighters are paid, but I guarantee you it is not enough.

On the other hand, the city has limited resources, and public employees need to accept the same realities that private-sector employees are facing.

As I watched the July 7 meeting, I couldn’t help but imagine what would have happened to me if I marched into my employers’ office and started shouting “shame on you” because I was upset about a lack of a raise or losing some benefits. If my employer asked me to wait in the hallway for a few moments while things settled down, and I refused to budge, what do you think would happen?

I would be looking for another job.

That’s how it works in the real world.

Furthermore, it is beyond ironic that public safety employees would refuse to comply with public safety regulations.

Earth to Teamsters: The mayor was not asking you to leave or trying to silence your voices. He simply asked a few of you to step into the adjacent hallway and wait your turn to speak. Was that such an unreasonable request?

Stomping your feet and shouting is for two-year-olds, not for adults.

And let’s be clear, this is not the first time when have witnessed junior high school theatrics from the Teamsters.

During my tenure as a newspaper editor, I recall previous contract negotiations that were just as heated and just as contentious. In fact, during one council meeting, several union members circled City Hall in their vehicles, honking their horns repeatedly in order to disrupt the meeting.

In summary, there’s plenty of blame to go around in this situation. I strongly suggest that the mayor, every member of the city council and the Teamsters all put on their big-boy pants and negotiate in good faith.

Our public employees should be treated with respect.

That respect should also be reciprocated.

No woman, no cry in Biddeford

Critics of the Republican Party often say the GOP is the party of old, white men: a diminishing demographic  in a nation with increasing diversity.

Although I am hesitant to generalize the Republican Party, I can say with confidence that the Biddeford City Council is more white than the Academy Awards or the snow that is piled six-feet high in my front yard.

Furthermore, the council is completely dominated by testosterone-driven men.

You would be hard-pressed to say that the current council truly represents a city that is one of the most diverse communities in southern Maine.

A couple of weeks ago, City Councilor Brad Cote abruptly resigned from the good ol’ boys club.

Thus, Mayor Alan Casavant (another old, white guy) now has a unique opportunity to help diversify the council. By mid-March, Casavant is expected to nominate a replacement for Cote.

From there, the old, white guys on the city council will vote on whether to approve or reject Casavant’s nomination.

Casavant is limited. He must pick a replacement from Ward 3, one of the city’s more affluent neighborhoods (although it has nothing on Ward One, which includes Biddeford Pool and Fortunes Rocks).

But there are plenty of qualified women residing in Ward Three. Off the top of my head, I think of Bonnie Pothier, a former mayor. That said, Casavant told me Pothier has work commitments that preclude her from serving.

Or how about Carrie Varney Pelletier, an outspoken conservative who does not hesitate to offer her views on social media?

Or maybe Valerie Pelletier, who previously served on the airport commission and like Cote had misgivings about the airport?

The point is that the current council could benefit from a woman’s perspective. Women tend to see challenges from a more global viewpoint versus the linear approach of their male counterparts.

There are many fine women in Biddeford (I know because I’m married to one).

The trick for Casavant is finding one who lives in Ward Three and wouldn’t mind spending a lot of time with a lot of old white men.

Ready To Serve

GOP presidential hopeful Mitt Romney and Biddeford Mayor Alan Casavant had at least on thing in common on Tuesday.

Both men showed their detractors that they are as tough as nails and more than ready for a political fight.

Although Casavant’s nomination of Michael Ready for the vacated Ward Seven council seat was approved by an unexpected 7-1 vote, it included more than 30 minutes of sometimes emotional and heated commentary.

The final outcome also caused a member of the city’s planning board to announce her resignation as a protest against what she described as nothing more than “political theater.”

But any lingering doubts about Casavant’s ability to move the council when needed quickly evaporated Tuesday.

Councilor Melissa Bednarowksi also proved she is more than willing to stand as the council’s lone voice of dissension.

At issue were two competing philosophies about who should be appointed to fill the council vacancy that was created last month when David Flood gave up his seat to again pursue a career as a newspaper publisher.

Bill Sexton was one of three candidates who actively campaigned for the seat in November, but finished in second place behind Flood.

Ready previously served on the council, and Casavant said Ready’s prior experience — especially since the council is facing the prospects of  a daunting budget debate — is what mattered.

Casavant remained steely eyed during the floor debate, signaling confidence in his ability to shore up the votes he needed.

But many of the councilors seemed torn, and at times appeared emotional and wavering with their decision.

“This is a tough situation,” said Councilor David Bourque, looking toward the audience, where both Ready and Sexton were seated with their family members. “It’s a tough spot for us to be in.”

Council President Rick Laverierre, however, said the council had a sworn obligation to uphold Casavant’s appointment unless they could offer a compelling reason why Ready should be disqualified from service.

“I, too, find myself in a quandary,” Laverierre explained. “But we need to remember we’re talking about the charter, and the charter is clear about how we should approach this.”

Councilor Roch Angers said he felt physically ill about the dilemma.

“I feel sick to my stomach for both of these men,” Angers said. “It should be the people saying how things go. We should be listening to the input of people from Ward Seven.”

Angers, who helped the mayor during last year’s campaign, then questioned Casavant directly, asking him if he would consider Sexton for nomination.

The mayor did not flinch. “I have a nomination on the table,” he replied curtly.

The tension in the room was palpable.

Councilor Richard Rhames voiced concerns about Ready’s appointment, reminding his fellow councilors that Ready was one of the “MERC 5,” a group of five city councilors who approved a controversial, five-year extension of the city’s contract with the Maine Energy Recovery Company in 2007.

Members of the public were equally divided on the issue. Sexton’s parents and his son all addressed the council, urging them to support Bill Sexton, but also praised Ready.

“Mike [Ready] is a nice man, but Mike didn’t run for the seat,” Sue Sexton told the council.

Sexton said she understood why Ready wants to help the city now, but reminded councilors that her son ran a hard campaign and went door-to-door, looking for votes and listening to residents’ concerns.

Bill Sexton also praised Ready, but had strong words for the mayor.

“The mayor knows nothing about me,” Sexton said. “He never called me. I have been referred to as a puppet, or maybe it’s because [I’m a Republican] or because I supported the casino. I don’t know, but I just want a shot at what I worked so hard for.”

Sexton closed his remarks by reminding Casavant of his mayoral campaign pledge to be a “positive, professional” mayor.

“I ran my own campaign in a positive, professional way,” Sexton said. “This should be about what’s best for the city. The charter gives you the power to appoint but that does not mean you should just pick your friends.”

Judy Neveaux, a resident who also worked on Casavant’s campaign, reminded the council that Casavant was supported by an overwhelming margin of voters in November.

“The people clearly trust this mayor to do what is right for our city,” she said. “I think it’s important to let the mayor do his job.”

Although the comments were often tense and sometimes pointed, resident Ron Peaker brought the evening to an all-time low by accusing Flood of being “dishonest” about his intentions during the campaign.

Bill Sexton later denounced Peaker’s remarks, calling them “inappropriate and pure speculation.”

Just moments after Ready was sworn in by City Clerk Carmen Morris, Sue Sexton asked the mayor if she could approach the podium. She thanked Ready for his willingness to serve and wished him well.

Sue Sexton told All Along the Watchtower that she would be resigning her seat from the Planning Board as a protest to Casavant’s appointment.

“Despite all the things he said during his campaign, it has become painfully honest that our new mayor is just playing political favorites,” she said.

Should I stay or should I go?

If Elmer Fudd had attended Tuesday’s Biddeford City Council meeting, he may have made the following observation about our city councilors:

“Those wascly wabbits seemed especially wambunctious last night.”

Fudd’s assessment matches my own observations.

Watching the councilors in action, I actually began to wonder whether  a couple of our council critters had skipped their required rabies vaccinations, especially when they began talking about a favorite City Hall subject: solid waste disposal.

If you missed the meeting, then you also missed a rare opportunity to hear one of the city’s most eloquent and handsome residents address the council about the contentious issues surrounding trash and recycling.

No, Jim Grattelo did not show up last night.

It was me — yours truly — the voice of logic, reason and nicotine addiction from Ward Seven.

At issue is the perennial topic of how to both increase the city’s recycling rate and reduce the amount of trash we send to the Maine Energy Recovery Company, where household waste is recycled into electricity.

Council President Rick Laverierre seemed ready to explode or at least pop a button on his new suit, when he railed against the concept of a pay-per-bag trash collection system.

“This is not a Maine Energy thing,” he said, ignoring the obvious and hoping to avoid taking a public stance on a very controversial issue.

Laverierre strongly supports sending no less than two referendums to the city’s voters.

The first referendum would ask voter permission to even allow the council to discuss or say the words “pay-per-bag,” and the second referendum (a few months later) would ask the voters whether they approve a plan. Seriously.

For the first time in 192 years, I found myself in agreement with Councilors David Flood and Richard Rhames.

The last time the three of us agreed on a topic was in 1820, when we published a joint op-ed in the Boston Globe, making the case for Maine’s secession from the state of Massachusetts.

The opening line of that editorial proves the piece was a collaborative effort:

“For whatever. Massachusetts blows. We need another state where Democrats can control the Legislature.”

Back to last night’s meeting. Rhames, for a brief moment in time, seemed lucid with a firm grasp of the obvious.

Rhames reminded his fellow councilors that they will soon be forced to review the city’s waste disposal contract.

“This council needs to be grappling with this issue,” he said. “This matter is roaring up on us. It is not a simple issue and, unfortunately, we have not yet begun to consider our position.”

But Councilor Michael Swanton expressed doubts about how much the city would save its taxpayers by forcing the Solid Waste Commission to devise a plan that could increase the city’s recycling rate. “I ran the numbers at home,” he said. “And I figured out that I would save about 37 cents per week by recycling more.”

The council, however, did seem to agree on one thing: trash disposal involves a lot of fluctuating numbers, a good pair of rubber gloves and the willingness not to hoard No.2 plastic bottles.

Ultimately, the council voted 8-1 (Laverierre opposed) to kick the can down the road for another few weeks by sending a resolution to the Solid Waste Commission that seeks to increase the city’s recycling rate.

Take the money and run

Earlier in the evening, the council took up the issue of ethics, pondering whether to amend the city’s ordinances to require members of the Planning Board to sign a code of ethics.

It should be noted that members of the city council are not required to sign a code of ethics.

As I have explained to my children, whether you should take a 10-dollar bill from your mother’s purse is NOT an ethical dilemma.

It is a crime.

An ethical dilemma is a situation in which both choices have merit and must be carefully weighed against one’s own values and belief system.

At first blush, it seems more than reasonable to ask city officials to sign a code of ethics. But a closer examination of the proposed language reveals some glaring problems that leap off the pages and then steal money from your mother’s purse.

For example, Councilor David Flood (my neighbor, former employer and BFF) pointed out that by signing the code, planning board members would be required to only do reasonable things that also “appear to be reasonable.” Again, I’m not kidding.

If this same standard were applied to the city council, we would not have a city council.

Upon realization of this quandary, the council pondered their own ethical dilemma and rejected adopting a code of ethics for other people to follow.

Smart move.

In other business, the council put the brakes on a proposed policy that would allow the city to accept private contributions for public infrastructure.

After hearing further words of wisdom from yours truly about the slippery slope of unintended consequences, the council decided to send the proposed policy to the “Policy” Committee for further review and clarification.
